You cannot invent an extra service charge share from the fact that a leaseholder's demise includes a parking space. The percentages in the leases are exhaustive. The tribunal also held it had no jurisdiction over standalone parking space leases at all, because a parking space is not a dwelling, so those charges go to the County Court instead. Check that before budgeting major works across a mixed-tenure block.

On roughly 1.5 million pounds of balcony works, the waterproof membrane was held to be part of the exterior main structure because its purpose is to protect the slab, with structural implications for other flats. Decorative tiling is within the demise, but if it has to come up to reach the structure, the taking up and making good falls to the landlord. The tribunal declined to rule on cost because there was no priced specification and no tenders.

Decided seven months before Keverstone Court and landing on the same line: concrete slabs, asphalt finishes, upstands, rails, glazed panels and drainage are recoverable, balcony tiles are demised to the leaseholder, and making good tiles removed to reach the structure is the landlord's. If you manage a Bournemouth block with cantilevered balconies, this pair is the template. Winning a prospective declaration also does not foreclose a later challenge on consultation.

Where the Lands Chamber has already construed the service charge provisions of leases in your development, the tribunal cannot depart from that construction for other flats in the same building. The appeal was allowed because the first-instance tribunal had put a different gloss on wording already decided. The foundation authority for the Rockstead line, applied again fifteen years later. Each flat contributed only to the specific items its own lease named, and service charges were not payable in relation to costs other than those. It is why a converted house in Bournemouth cannot simply divide everything equally: where a lease picks up only named shared items, everything outside that list is irrecoverable however reasonable it is.

The most valuable case here for a director who has found a recovery gap. A 999 year lease granted in 2004 still managed to omit structure, roof and foundations from the recoverable list. All 96 leases were varied in one order, with the Chief Land Registrar directed to note it. The thresholds are 75 per cent consent and not more than 10 per cent opposed.
