The most important major works decision in the county. Lessees of 13 of 56 flats challenged charges arising from 1,510,004 pounds of expenditure, principally works to the River Wall, and lost on everything but a fifth of the garage electric meters. The tribunal applied a range of reasonableness rather than a best value test, and held that even where it agreed the boundary wall should have been looked at earlier, the challengers had not proved a lower cost would actually have been achieved.

A 39,605 pound basement damp proofing budget came down to 29,412 recoverable, because the lessor's repairing covenant is not to provide a damp free flat but is limited to damp proofing the structural and external walls. The freedom to choose a long term repair over a patch applies only within the obligations the lease actually imposes.
