The deployed judge procedure: a County Court arrears claim was transferred so one judge decided the payability question as the tribunal and then entered judgment as the County Court in a single hearing. That is the efficient route for a company pursuing arrears where the charges are disputed. Be realistic though: the claim was cut by about 29 per cent and the leaseholder's partial success halved the recoverable tribunal fee.

What the Council Charges an Empty Flat in Swindon

Swindon's empty premium runs at 100 per cent after one year, 200 after five and 300 after ten, and the council publishes these as the resulting total charge as well as the premium, so 100 per cent premium reads as 200 per cent payable. Its second homes premium of 100 per cent starts on 1 April 2026, later than Dorset and Bournemouth, Christchurch and Poole, who began on 1 April 2025, and unlike neighbouring Wiltshire, which charges none. Swindon does not publish a commencement date for the empty bands themselves.

What We Do About Service Charge Disputes in Swindon

How that becomes a service here, working from what Swindon Borough Council publishes:

  • Keep administration charges to what the lease supports and the tribunal has accepted here.
  • Answer the empty-property question with Swindon Borough Council's own premium rather than a general rule.

We charge a fixed annual fee for management and take no commission on contractor work. A building in Swindon pays the contractor's price, not the contractor's price plus ours.

How This Works, in General

The law here is the same in Swindon as it is anywhere in England, and it is set out in full on our service-charge-financial-management page rather than repeated on this one. What changes locally is above: the authority, the figures, and what the tribunal has actually done with cases nearby.

Everything else we do in the area is on the Swindon page, and the full matrix is at services by area.
