On the council side it can serve improvement notices, prohibition orders and hazard awareness notices under the Housing Act 2004, prosecute for an unlimited fine, impose a civil penalty, enter a landlord on the rogue landlord database for a minimum of two years, and seek a banning order with no maximum term. On the fire authority side, prohibition notices and prosecution, where any indictable offence carries up to two years' custody. Both bodies are interested persons under the Building Safety Act and can apply to the tribunal for remediation orders and remediation contribution orders.
Who Regulates a Tall Building in Plymouth
Plymouth is the only council in the South West with a named joint team for tall buildings, and it publishes the numbers. The High Rise Building Team was formed in January 2023 with Devon and Somerset Fire and Rescue Service and combines environmental health, fire safety and building control specialists. Its published policy states that Plymouth has 73 buildings of 18 metres or more, of which around 56 are believed to meet the higher-risk description, and around 10,000 buildings of 11 metres or more. It works top down by risk rating and runs a standard two day initial inspection per higher-risk building. What it does not publish is the list: the counts and the method are public, the buildings are not.
